By accessing or using the Website or the EPA Service, you agree to these Terms of Use ("Terms"). If you do not agree to these Terms, you must refrain from using the Website or the EPA Service.

1. General Information

1.1. The Website is operated by The Legal Drive Limited ("we," "us," or "our"), a company registered in New Zealand.

1.2. These Terms are governed by New Zealand law. By using this Website, you submit to the exclusive jurisdiction of the courts of New Zealand.

2. Use of the Website

2.1. You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Website.

2.2. You must not engage in any activity that damages or disrupts the Website or its operation.

3. Intellectual Property

3.1. All content, logos, trademarks, and other intellectual property displayed on the Website are the property of The Legal Drive Limited or its licensors.

7. Privacy

7.1. Our collection, use, and storage of personal information are governed by our Privacy Policy, which is available on the Website.

8. EPA Service

8.1. What the EPA Service is. The EPA Service is an AI-assisted tool that helps you prepare the text of an Enduring Power of Attorney ("EPA") — in relation to property and/or personal care and welfare — in the prescribed forms under the New Zealand Protection of Personal and Property Rights Act 1988 (the "Act"). The EPA Service records the choices you make, collects details about you and the people you nominate, and produces a PDF for you to sign and execute.

8.2. Software interaction is not legal advice. Using the EPA Service interface — making selections, entering details, and generating a draft document — does not by itself create a lawyer-client relationship between you and The Legal Drive Limited, and the AI-generated outputs of the interface are not legal advice. A lawyer-client relationship arises when you engage a lawyer at our firm to witness your EPA (see clause 8.6); legal advice given by that lawyer in connection with the witnessing engagement is provided in that capacity.

8.3. Eligibility. You may only use the EPA Service if you are the intended donor of the EPA, are at least 18 years of age, have the mental capacity required by the Act to create an EPA, and are present and acting on your own behalf (not under duress). By using the EPA Service you confirm that all of these are true.

8.4. Accurate information. You must provide true, complete, and current information about yourself and about anyone you nominate as an attorney, successor attorney, consultation person, or information person. Inaccurate or out-of-date information may result in an EPA that is ineffective or that does not reflect your wishes, and we are not responsible for any consequence flowing from information you supply.

8.5. Information about other people. When you enter information about other people into the EPA Service, you are representing to us that you may lawfully do so for the purpose of producing your EPA. You should tell the people you nominate that their details will be recorded on the face of the document and that they have access and correction rights in relation to that information.

8.6. Witnessing your EPA. An EPA is only effective once it has been validly signed and witnessed. The Legal Drive Limited operates a law firm, and the EPA Service is delivered together with the legal services of a lawyer at the firm to witness your signature and complete the Certificate of Witness in the form prescribed by the Act. The lawyer who witnesses your EPA acts as a New Zealand lawyer subject to the duties of professional conduct that apply to that role, including the duty to be satisfied as to your understanding and capacity to make the EPA.

8.7. AI-generated content. Parts of the EPA Service use AI language models to answer your questions, to interpret free text you type, and to classify chat messages. AI output may be wrong, incomplete, or inconsistent with your actual intention. You are responsible for reviewing the content of your EPA before signing. If anything in the generated document does not match what you intend, do not sign it — go back and correct it, or raise it with us. Signing and executing the EPA is a deliberate, reviewable step, and the legally operative document is the signed version, not the draft produced by the service.

8.8. No warranty of legal validity. While we design the EPA Service to follow the forms prescribed under the Act, we make no warranty that any particular document produced by the service will be held valid by a court, a bank, a rest home, the Family Court, or any other decision-maker. Validity will depend on facts outside our control, including how the document is signed and witnessed and your circumstances at the time of execution and use. You are responsible for satisfying yourself that your EPA is properly executed.

8.9. Beta service. The EPA Service is provided on a beta basis. We may change, suspend, discontinue, or alter the features of the service at any time, with or without notice. Downtime, feature changes, or bugs may occur.

8.10. Acceptable use. You must not use the EPA Service to impersonate another person, to pressure or coerce another person into signing a document, to create an EPA on behalf of someone who is not present with you and does not have capacity, or for any unlawful purpose. You must not attempt to extract another user's information from the service, attempt to disrupt or probe the service, or submit content you know to be false or misleading.

8.11. Your data. The EPA Service collects and handles sensitive personal information about you and the people you nominate. Please read the Privacy Policy, which describes what we collect, how long we retain it, how it is encrypted, and who can see it.

8.12. Deletion and account closure. You may ask us to delete your EPA record at any time, as described in the Privacy Policy. If your EPA has already been signed and witnessed, the legally effective document is the signed paper or PDF version that you hold; deleting the record in the EPA Service does not revoke an EPA. Revocation must be done in accordance with the Act.

8.13. Liability specific to the EPA Service. In addition to the general limitation in clause 5, and to the fullest extent permitted by law, The Legal Drive Limited is not liable for: (a) the validity, enforceability, or effect of any EPA produced using the EPA Service; (b) any consequence flowing from information you or any other person provided that turned out to be inaccurate or out-of-date; (c) any loss caused by your reliance on AI-generated content that you did not review before signing; or (d) any loss caused by unavailability of the EPA Service. Nothing in these Terms limits any right you have under the Consumer Guarantees Act 1993 where that Act applies, or any duty owed to you by a lawyer at our firm in their professional capacity under clause 8.6.

9. Changes to These Terms

9.1. We may update these Terms from time to time. Any changes will take effect when posted on the Website. Your continued use of the Website constitutes your acceptance of the updated Terms.
